HostRacer Terms and Conditions (TOS)

Introduction

These Terms of Service (TOS) outline the rules and regulations for the use of HostRacer's Website.

Customer Agreement

Customer agrees to use HostRacer services in a manner consistent with all applicable laws. HostRacer reserves the right to cooperate with law enforcement agencies if necessary.

Acceptable Use

• User must follow the Acceptable Use Policy of any network they connect to, including HostRacer's system.
• HostRacer and its Information Providers are not responsible for damages from User's use or inability to use HostRacer.
• Materials submitted for publication must not violate copyright, trademark, or other rights and must not contain obscene or libelous content. Hosting of adult or pornographic content is prohibited on shared and reseller servers.

Netiquette Violations

• Posting excessive articles to newsgroups or off-topic posts.
• Sending unsolicited mass emails.
• Harassing individuals online after being asked to stop.
• Impersonating other users or falsifying user information.
• Using unauthorized proxies or scripts for abuse.

Accounts involved in violations will be suspended and potentially terminated, with costs of complaint responses charged to the user.

Resource Usage

• User agrees not to overuse resources, limited to 1 CPU core, 1GB memory, and other specified limits.
• Excessive resource usage may lead to suspension or requirement to upgrade to higher plans.
• HostRacer reserves the right to adjust limits as necessary to maintain server stability.

Data Policy

HostRacer performs daily and weekly backups for accounts under 20GB. However, HostRacer is not responsible for lost data, and clients are encouraged to maintain their own backups for critical data.

Prohibited Free Services

Users must not use HostRacer hosting to offer free services (e.g., web hosting, email, image hosting). Violating this may result in immediate suspension.

File Hosting Prohibition

File hosting or storage is prohibited on shared and reseller servers. HostRacer is strictly for website hosting.

Abuse of HostRacer Staff

HostRacer requires respect toward staff and reserves the right to suspend accounts for abusive conduct, including rude language or false information provided to staff.

Payment Issues

• Payments must be made on the monthly anniversary date.
• Non-payment may result in suspension or termination of services and destruction of data after 14 days.
• It is the user’s responsibility to ensure payment methods have sufficient funds.

Public Feedback

Posting negative feedback about HostRacer without first discussing issues with the Complaints Department may result in immediate account termination.

Refunds

The refund policy does not cover additional items, including domain registration and dedicated servers.

Cancellations

• Accounts may be canceled through the HostRacer website with five days' notice prior to billing date.
• HostRacer does not provide prorated refunds for cancellations.
